{"id":2099,"date":"2018-11-29T21:51:00","date_gmt":"2018-11-29T21:51:00","guid":{"rendered":"http:\/\/parentswholead.org\/?p=2099"},"modified":"2020-08-01T00:59:23","modified_gmt":"2020-08-01T00:59:23","slug":"2099-2","status":"publish","type":"post","link":"https:\/\/parentswholead.org\/es\/2099-2\/","title":{"rendered":"Take Action on Immigration Policy Change"},"content":{"rendered":"\n<p><strong>Take Action on&nbsp;Immigration Policy Change: &#8220;Inadmissibility on&nbsp;Public Charge Grounds&#8221;&nbsp;<\/strong><br><strong><em>A Proposed Rule by the U.S. Department of Homeland Security on October 10, 2018<\/em><\/strong><br><br><strong>ACTION:&nbsp;<\/strong>Submit public comment by December 10, 2018 (details follow below).<br><br><strong>BACKGROUND:<\/strong>&nbsp;As a core member partner of United Parent Leaders Action Network (UPLAN), the National Parent Leadership Institute (NPLI) brings this important issue forward to inform parent leaders and partners on this critical proposed immigration policy change that will affect immigrant families across the United States. U.S. Citizenship and Immigration Services under the Department of Homeland Security (DHS) has&nbsp;<strong><em>proposed changes that would make it more difficult for immigrants applying for legal permanent residence (green card), visa or adjustment status to receive approval&nbsp;<\/em><\/strong>based on them being determined&nbsp;<em>public charges<\/em>. Simply put, public charges are people deemed to be primarily reliant on public resources to meet their needs, rather than rely on their own capabilities and the resources of their families, their sponsors, and private organizations. [<a href=\"https:\/\/www.gpo.gov\/fdsys\/pkg\/USCODE-2015-title8\/pdf\/USCODE-2015-title8-chap14-sec1601.pdf?mc_cid=1d19e824fe&amp;mc_eid=\">INA 8 U.S.C. \u00a7 1601 (PDF)<\/a>]<br><br>Current U.S. law requires that immigrants demonstrate financial self-reliance or self-sufficiency. The Immigration and Nationality Act (INA) states that an applicant is&nbsp;<em>inadmissible&nbsp;<\/em>if he\/she is determined \u201clikely at any time to become a public charge.\u201d The INA itself does not communicate strong evaluative measures for determining whether an immigrant is likely to become a public charge. Rather, it lists five factors to be \u201ctaken into account:\u201d (1) age; (2) health); (3) family status; (4) assets, resources and financial status; and (5) education and skills.&nbsp;&nbsp;<strong><em>Some families would have to choose between meeting basic needs like food and health care, or securing legal status to live together as a family in the U.S. under the proposed changes.<\/em><\/strong><br><br><strong>What Can You Do To Help?<\/strong><br>There is a 60-day period before the proposed rule can be adopted; this allows time for public comments to oppose it. &nbsp;This is your opportunity for civic engagement &#8211; speak up for immigrant rights so that this proposal is not adopted.<br><br><strong>1.
